A while back I sent to my clients a copy of the Federal Register disclosing the DOL’s final rule on Notification of Employee Rights, which increases the compliance requirements, restrictions on government contractors and penalties related to employee rights to unionize.  I feel it is necessary to share this requirement with any of you that have government contracts. 

 

Since issuance of this rule DOL has been working on enforcement criteria.  Well the next shoe has fallen.

 

The Department of Labor’s Office of Federal Contract Compliance Programs (“OFCCP”) recently issued a directive which outlines the agency’s new protocol for compliance reviews of federal contractors and subcontractors. Going forward, every 25th employer on the OFCCP's scheduling list will be selected for a full compliance review (an onsite investigation by OFCCP compliance officers). So, you may want to conduct an internal audit to see if your AAP is accurate and if you are in compliance with Exec. Order 13496 before the agency contacts you to schedule a desk audit.
